Terms of Service

Last updated October 27, 2026

These terms govern your use of Moatless (moatless.store), a marketplace where developers sell access to codebases. Moatless is operated by WeBuilt LLC ("Moatless", "we", "us"). By creating an account, buying, or selling on Moatless, you agree to these terms.

Accounts

You need an account to buy or sell. You can sign in with GitHub or with a link sent to your email address. You're responsible for activity on your account and for keeping your API keys secure. Each API key can be revoked from Settings at any time.

Buying

When you buy a listing, you get access to the release that's current at the time of purchase, delivered as a git repository you can clone with an API key. If you also subscribe, you get access to every release the seller publishes while your subscription is active and paid.

When a subscription ends, you keep access to every release you were entitled to while it was active. To get releases published after it ends, you can buy the listing again.

Prices are shown on each listing and charged in US dollars. Moatless processes the payment as the merchant of record, through Stripe. Applicable taxes may be added at checkout.

Subscribing includes buying the listing's current release. After that, a subscription is charged at the end of each billing period (a month or a year, as the listing says) in which the seller published at least one new release, at the subscription's price. A period without a new release isn't charged. Subscriptions continue until you cancel. You can cancel any time from the billing page linked in your Library; cancellation takes effect at the end of the current period, and if a release was published during that period, it's charged for when it ends.

Code is delivered as soon as you've paid. At checkout, you ask for it to be delivered right away, and acknowledge that once it's delivered, you lose any right to withdraw from the purchase, including the 14-day right of withdrawal under EU and UK consumer law. Refunds are covered by our Refund Policy.

License for purchased code

Unless a listing states otherwise, each purchase gives you a non-exclusive, non-transferable license for one person or one organization to:

  • use, copy, and modify the code, and
  • build, deploy, and operate products and services with it, including commercial ones.

You may not resell, sublicense, or redistribute the source code, or a version of it that is substantially the same, as a codebase, template, or starter kit, and you may not make it publicly available. Products and services you build with the code are yours, and are not restricted by this license.

The license comes from the seller. Moatless facilitates the sale and delivery but does not own the code.

Selling

To sell, you connect a repository and set up a payout account with Stripe. By listing a codebase, you confirm that:

  • you own the code or have the right to sell it on these terms,
  • it doesn't include code you're not permitted to distribute (check the licenses of any dependencies you include),
  • it doesn't contain malware, credentials, or other people's personal data, and
  • your listing describes the code accurately.

You give Moatless permission to copy, store, and deliver your code to buyers, and to show your listing's name, description, and images on the site and in marketing.

Moatless charges a fee of 10% of each sale, including each subscription payment. Stripe's fee for processing each payment is also deducted from your share, except for the part that comes from tax, which Moatless pays. If you redeem a founder code, Moatless charges the lower fee that comes with it on all your sales from then on, and if the code says so, Moatless pays Stripe's processing fees on them too. There's no fee on free listings. The rest is sent to your Stripe account, and Moatless pays it out to your bank every Friday for sales made at least 10 days earlier. Stripe sets its own requirements for receiving payouts.

If a sale is refunded, your share of it is taken back, along with the Stripe processing fee you paid on it, since Stripe doesn't return processing fees on refunds. If a buyer disputes a charge with their bank and wins, your share and the processing fee are taken back, and so is the fee Stripe charges for the dispute. A founder code that covers Stripe's processing fees doesn't cover dispute fees. When a refund is because of Moatless's mistake, such as a buyer being charged twice, Moatless pays these fees instead of you. You authorize Moatless to take these amounts from your Stripe balance. If that leaves your balance negative, it's recovered from your future sales, and Stripe may debit your bank account to cover it.

You can stop selling at any time by removing your prices. Buyers keep access to the releases they've already paid for.

Acceptable use

You may not use Moatless to:

  • sell or distribute code you don't have the rights to,
  • distribute malware or code designed to cause harm,
  • share purchased code in violation of its license,
  • interfere with the service, or access accounts or data that aren't yours, or
  • break the law.

We may remove listings or suspend accounts that violate these terms.

Disclaimers

Code sold on Moatless is provided by its sellers "as is". Moatless does not review or guarantee the quality, security, or fitness for any purpose of any codebase. You're responsible for reviewing code before you use it.

The service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.

Limitation of liability

To the extent permitted by law, Moatless and WeBuilt LLC are not liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the service or of any code bought through it. Our total liability for any claim is limited to the amount you paid Moatless in the 12 months before the claim.

Termination

You can close your account at any time by contacting us. We may suspend or close accounts that violate these terms. Licenses for code you've already bought survive the closing of your account.

Changes

We may update these terms. If we make material changes, we'll update the date at the top of this page and, where appropriate, let you know by email. Continuing to use Moatless after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States and of the state in which WeBuilt LLC is organized, without regard to conflict of law rules.
